in un pagamento a rate il bene rimane sempre di proprietà finche non è stata pagata l'ultima rata...questo lo dice la legge...:wink:
il problema delle multe in questo caso c'è, basta fargli firmare una dichiarazione di possesso del veicolo...
fatto sta che è una cosa che non farei mai in vita mia...
le probabilità che dopo la prima rata la mia macchina sia già dall'altra parte dell'europa sono del 99,9%, a quel punto che mi frega se l'auto è ancora mia, tanto non la vedo piu come nemmeno i soldi...

 

Assolutamente no. Il proprietario del bene i soldi li riceve dalla finanziaria, e poi rimane un'obbligazione che non pregiudica in alcun modo il passaggio di proprietà. Un conto è il diritto reale, il cui trasferimento è imediato; un altro conto è il diritto derivante dall'obbligazione, che permane tra le parti.

La cosa non cambia anche se non c'è una finanziaria, ma è una semplice dilazione di pagamento.

 

io non parlavo di finanziamenti, pagavo di pagamento a rate, che sono diversi, parlavo di come avrebbe potuto fare bigg con quello che voleva la sua macchina...

L'art. 1523 c.c. parla di un contratto particolare, la vendita con un patto (separato) con il quale il venditore si riserva la proprietà fino all'avvenuto integrale pagamento del bene.
Questa non è la regola, ma un'eccezione, però se bigg lo vuole fare ....

a parte non ci ho capito una mazza....pero'..cosi' l'intutito...

 

è successo anche a me, un signore dalla spagna che mi offriva una cifra davvero allettante.. gli avevo dato l'ok, lui mi ha chiesto: fammi sapere quando ti arriva il circolare che facciamo il trapasso..per precauzione non ho detto che mi era arrivato e l'ho depositato in banca(assegno apparentemente regolare banca santander)..gli assegni dall'estero impiegano più o meno un mese per essere verificati..quando mancavano pochi giorni, gli ho detto che mi era arrivato e che solo la settimana dopo sarei andato a fare il trapasso in modo da avere la certezza dalla banca...bene l'assegno è risultato falso e morale della favola mi sono pure pagato 40 euro di spese per controllo e incasso..

 

Ma per esempio...
Dove trovo una bel sito di spammer dove inserire l'indirizzo mail della fortunata acquirente della mia macchina?

 

Buona l'idea di fare un 3d "vademecum per evitare le truffe" privo di OT e con tutti i tentativi :wink:

Io ho provato a risondere una volta ad un email del genere e il tizio guardate un po cosa mi ha risposto:
